These terms and conditions (the "Terms") constitute a legal agreement between you (the "Service User" or "You") and Soul HeARTful (the "Organization," "We," "Us," or "Our") that govern your use of our services. By accessing or using any of our services, you agree to be bound by these Terms. If you disagree with these Terms, please refrain from using our services.

1. Service Description:

1.1. Soul HeARTful is a non-profit organisation that provides experiential art programs, counselling, psychotherapies, and workshops to enhance emotional growth, self-discovery, and resilience in children and youths.

2. Service Use:

​

2.1. You agree to use our services for their intended purpose, including participating in the programs, workshops, and counselling sessions offered by Soul HeARTful.​

2.2. You may need to provide personal information for certain services. Please refer to our Privacy Policy for details on how your information is handled.

3. Workshop Attendance:

​

3.1. Participants are kindly requested not to attend if they are feeling unwell or showing symptoms of illness, including but not limited to fever, cough, or sore throat. Please inform us at least 3 hours in advance if you cannot attend a scheduled workshop. Your cooperation is greatly appreciated and helps ensure the safety of all participants and staff.​

3.2. If you choose to attend a workshop, you agree to adhere to the workshop rules and guidelines set by the Organization and its instructors.

3.3 Participants are required to have an on-camera policy at all times for sessions conducted on Zoom. This is to ensure the safety of all participants as from time to time instructors will need to check on all participant's well-being. Please do not sign up if you are uncomfortable with switching on camera policy.

4. Eligibility:

​

4.1. Our services are primarily intended for children, youths, seniors and persons with disabilities.

​

4.2. Some programs or services may have specific eligibility criteria or age restrictions. It is your responsibility to verify your eligibility for any program or service. From time to time we may include participants from another age group. This might be due to their intellectual capacity, and an assessment will be conducted before the final decision. All decisions are final and at the discreet of Soul HeARTful.

4.3 Parents or legal guardians must declare if their child has been diagnosed by a professional psychologist or psychiatrist with any emotional or mental health condition. This information is important to better tailor our workshops and support to the child's specific needs. Rest assured, we do not exclude any child from our activities based on such conditions. Instead, we aim to equip our workshops with professionals who best support your child's well-being and development.

5. Cancellation and No-Shows:

5.1. If you need to cancel your attendance for a workshop or program, please inform us as early as possible. This allows other participants to take your place.

5.2. Frequent no-shows may affect your ability to participate in future workshops or programs.

​

6. Code of Conduct:

​

6.1. Violence against any participant, instructor, or staff member will not be tolerated and is strictly prohibited. Soul HeARTful is committed to providing a safe and respectful environment for everyone. You agree to treat all participants, instructors, and staff with respect and kindness.

6.2. Participation: Active participation in workshops and programs is encouraged but not expected.

​

6.3. Non-Discrimination: Discriminatory behaviour or hate speech is not tolerated.

7. Consent:

7.1. You agree to participate in workshops and programs voluntarily and give your informed consent to engage in any therapeutic or art-related activities.

​

7.2. You SHALL NOT hold Soul HeARTful for any responsibility for accidents or fatalities arising from participation in our activities. While we take safety seriously and make every effort to ensure a secure environment, participants acknowledge and accept a certain level of inherent risk.

7.3. By participating in group workshops, all participants consent to using their photos on printed or digital media for promotional purposes. Your images may be used to showcase the positive impact of our programs, but your personal information will not be disclosed.

8. Data and Privacy:

8.1. Your data is handled in accordance with our Privacy Policy. By using our services, you consent to collecting and using your data as outlined in the policy.

9. Changes to Terms:

9.1. We reserve the right to amend these Terms at any time. Any modifications will be posted on our website, and you must review them periodically.

10. Termination:

10.1. We reserve the right to suspend or terminate your access to our services if you breach these Terms or if we have reason to believe that your participation may be detrimental to yourself or others.
